I. General Provisions

§1 Definitions

The terms used in these Terms and Conditions, hereinafter referred to as the "Regulations," shall mean:

  1. “Natura Atelier”Marta Leśniewska-Mizerek, conducting business activity under the company name NATURA ATELIER Marta Leśniewska-Mizerek, ul. Bukowa 54, 76-200 Słupsk, Poland, registered in the Central Register and Information on Economic Activity (CEIDG) in Poland – NIP: 8393257733, REGON 542494330.

    • Correspondence, Registered Office, and Returns/Complaints Address: ul. Bukowa 54, 76-200 Słupsk, Poland.

  2. “Store” – The online store located on the website https://www.naturaatelier.com and its subpages. The Controller of the Store's customer personal data is Natura Atelier.

  3. “Buyer” – Any person who has entered into an agreement with Natura Atelier for setting up an account in the Store or has placed an order without entering into such an agreement; this term also refers to a person who does not have an Account and is in the process of placing an order.

  4. “Account” – The Buyer's account established by the Buyer in the Store in accordance with the rules set out in the Regulations.

  5. “Consumer” – A person defined in Article 22[1] of the Polish Civil Code.

  6. “Sole Trader-Consumer” – A natural person entering into a contract with Natura Atelier within the scope of the Store, directly related to their business activity, when the content of that contract indicates that it is not of a professional nature for that person (in accordance with Polish Consumer Rights Act).

 

§2 Principles of Service Provision

 

  1. The Regulations set out the rules for the provision of electronic services by Natura Atelier to Buyers, enabling them to:

    • Conclude contracts for the sale of goods available in the Store's assortment at prices provided on the respective subpages of the Store.

    • Add goods from the Store's assortment to a wish list.

    • Create an Account.

  2. Purchases in the Store can be made without setting up an Account or after setting one up.

  3. Information provided in the Store (photos, descriptions, prices) constitutes an invitation for Buyers to submit offers to conclude a sales contract (Art. 71 of the Polish Civil Code).

 

§3 Prices and Assortment

 

  1. The prices of goods in the Store's assortment are expressed in Polish Złoty (PLN) or another currency indicated on the website and include VAT.

  2. Natura Atelier may modify the assortment, prices, and conduct promotional campaigns. Changes do not affect sales contracts already concluded with Buyers.

  3. Gift cards, unless otherwise stated in a separate regulation for such a card, may be redeemed only once and are not exchangeable for cash.

 

§4 Sales Conditions and Delivery (Geoblocking)

 

  1. Natura Atelier delivers goods purchased in the Store within the European Union and non-EU European countries.

  2. In accordance with the requirements of Regulation (EU) 2018/302 (Geoblocking), a Buyer residing or staying in another country may also make a purchase in the Store, provided that the delivery address indicated is located in one of the countries to which Natura Atelier delivers.

  3. Natura Atelier declares that all goods offered in the Store are brand new, in conformity with the contract (in the meaning of consumer protection regulations), and have been legally introduced to the Polish market.

 

§5 Technical Requirements

 

  1. To use the Store, the Buyer's computer or other device does not need to meet specific technical conditions. Sufficient are: Internet access, an email address, a standard operating system, and an up-to-date web browser with JavaScript enabled.

  2. To properly use the Account and place an order, enabling strictly necessary cookies in the web browser is required. Detailed information about cookies is available in the Store's Privacy Policy.

 

§6 Prohibition of Unlawful Content

 

Buyers are prohibited from providing unlawful content while using the Store, meaning content that is contrary to law or decency.

 

II. Account Setup

§7 Account Setup Procedure

 

  1. A person wishing to set up an Account should select the "Create Account" option, fill out the form (name, surname, email, and password), and click the "Create" button.

  2. Filling out the form constitutes Natura Atelier's offer to the future Buyer to conclude an agreement for the Account setup. Clicking "Create" is equivalent to accepting this offer, and at that moment, the agreement for setting up the Account is concluded for an indefinite period.

  3. The Account must be activated by clicking the link sent to the email address provided during registration.

  4. If the Buyer is a Consumer or a Sole Trader-Consumer, they have the right to withdraw from the Account agreement without giving reasons within 14 days from the date of conclusion. The provisions of § 16 sections 2-4 shall apply accordingly.

 

§8 Data Security

 

Natura Atelier recommends that the Buyer carefully stores their login details to prevent unauthorized access.

 

§9 Account Functionalities

 

After setting up the Account, the Buyer can, in particular: edit their data, add and edit delivery addresses, place orders, add goods to the wish list, and view the status of orders.

 

§10 Liability for Digital Services (Account)

 

  1. Natura Atelier is liable for any lack of conformity of the digital service (Account) with the contract based on the provisions of the Polish Consumer Rights Act.

  2. Natura Atelier may change the digital service for reasons indicated in section 2 lit. a and b.

  3. If such a change significantly and negatively affects the Buyer's access to or use of the digital service, Natura Atelier shall inform the Buyer in advance on a durable medium about the nature and date of this change, and about the right to terminate the agreement without notice within 30 days of the change or notification thereof.

 

III. Order Placement

§11 Order Submission Rules

 

  1. The sale of goods is based on orders placed by the Buyer (with or without an Account).

  2. The sales contract is concluded in Polish or English.

 

§12 Sales Contract Conclusion Procedure

 

  1. The Buyer first selects goods and clicks the "Add to Cart" button.

  2. In the cart, the Buyer can make changes, add a comment, and proceed to checkout by clicking "Proceed to Checkout."

  3. At checkout, the Buyer provides/edits delivery data, selects the delivery method (with the cost), and optionally enters a discount code.

  4. The Buyer then selects the payment method. The "Total" column will display the total amount due (including the price of goods, delivery costs, and payment method costs). This summary constitutes an invitation to submit an offer.

  5. By clicking the “Order and Pay” button, the Buyer submits an offer to Natura Atelier to conclude the sales contract.

  6. Natura Atelier promptly sends an email with the confirmation of receipt of the offer (this is not the conclusion of the contract yet).

  7. In a subsequent email (or the same one), Natura Atelier informs the Buyer about the acceptance or refusal of the Buyer's offer. The sales contract is concluded when the Buyer receives the email confirming the acceptance of the offer.

  8. In case of advance payment (Blik, Przelewy24, card), the payment made by the Buyer is fully refunded in case of refusal to accept the offer.

  9. Natura Atelier notes that for goods delivered to countries outside the EU (e.g., the United Kingdom, Norway, Switzerland), the Buyer may be liable for local customs duties and VAT in the destination country. Natura Atelier is not responsible for these fees.

  10. Natura Atelier uses methods to detect and correct errors in data entered when placing an order by displaying a transaction summary and enabling editing of form fields before placing the order.

 

§13 Payment and Delivery

 

  1. Available payment methods include traditional bank transfer and electronic payment (fast internet transfer, Blik, Visa/Mastercard card payment).

  2. The Buyer should make the payment within 5 days from the date of concluding the sales contract.

  3. Delivery methods include courier shipment and parcel locker delivery.

  4. Shipping times are presented on the product pages in business days. When ordering several goods with different shipping times, the longest shipping time is taken into account.

  5. Natura Atelier recommends that the Buyer report any damage noticed upon unpacking the goods promptly, which facilitates the complaint process. This recommendation in no way limits the rights of Consumers or Sole Trader-Consumers.

 

§14 Electronic Invoices

 

The Buyer consents to Natura Atelier using electronic invoices for settlements.

 

§15 Wish List

 

The Buyer has the option to add goods to the wish list after logging into the Account.

 

IV. Returns and Complaints

§16 Right of Withdrawal (Return of Goods)

 

  1. If the Buyer is a Consumer or a Sole Trader-Consumer, they have the right to withdraw from the sales contract without giving reasons within 14 days from the day on which the Buyer or a third party indicated by the Buyer acquired possession of the item or the last item.

  2. To exercise the right of withdrawal, the Buyer must inform Natura Atelier of their decision by means of an unambiguous statement (in writing sent by post to: ul. Bukowa 54, 76-200 Słupsk, Poland, or by email to: kontakt@naturaatelier.com).

  3. The Buyer may use the model withdrawal form provided by Natura Atelier, but this is not mandatory.

  4. To meet the withdrawal deadline, it is sufficient for the Buyer to send the information concerning the exercise of the right of withdrawal before the expiry of the withdrawal period.

  5. In the event of withdrawal, Natura Atelier shall refund to the Buyer all payments received, excluding delivery costs, without undue delay, and in any event no later than 14 days from the day of receipt of the Buyer's withdrawal statement. The refund will be made using the same means of payment as used by the Buyer in the initial transaction, unless the Buyer has expressly agreed otherwise.

  6. Natura Atelier may withhold reimbursement until it has received the item back or until the Buyer has supplied evidence of having sent back the goods, whichever is the earliest.

  7. The Buyer must send back or hand over the item to Natura Atelier without undue delay, and in any event no later than 14 days from the day on which the Buyer informed of the withdrawal.

  8. Return Address: ul. Bukowa 54, 76-200 Słupsk, Poland.

  9. The Buyer bears the direct cost of returning the item.

  10. The right of withdrawal does not apply to a contract for the supply of an item that is non-prefabricated, manufactured according to the Consumer's/Sole Trader-Consumer's specifications or clearly personalized.

 

§17 Complaints (Lack of Conformity of Goods with the Contract)

 

  1. Complaints regarding the provision of electronic services (Account) or purchased goods should be submitted:

    • In writing (for goods): NATURA ATELIER – COMPLAINTS, ul. Bukowa 54, 76-200 Słupsk, Poland.

    • By email: kontakt@naturaatelier.com.

  2. The complaint must include: the order number, the Buyer's contact details, and a detailed description of the event forming the basis of the complaint.

  3. Natura Atelier shall respond to the complaint within 14 days from the date of receipt. Complaints regarding the lack of conformity of goods with the contract (for Consumers and Sole Trader-Consumers) and warranty (for other Buyers) can be submitted up to 2 years from the purchase of the product.

  4. In the event that repair or replacement of the goods in conformity with the contract is not possible, a refund of costs will be issued in accordance with the law.

  5. Refunds for payments made with a gift card are issued in the form of a new gift card.

 

V. Duration of the Account Agreement

§18 Agreement Duration

 

The Account agreement is concluded for an indefinite period.

 

§19 Termination of Account Agreement

 

  1. The Buyer may terminate the Account agreement at any time with immediate effect.

  2. Natura Atelier may terminate the Account agreement:

    • With immediate effect, if the Buyer violates the prohibition specified in § 6 of the Regulations at least twice.

    • With 30 days' notice, if Natura Atelier decides to cease operations of the Store.

 

VI. Amendments to the Regulations

§20 Rules for Amending the Regulations

 

  1. Natura Atelier has the right to unilaterally amend the Regulations only if one of the reasons specified in section 1 lit. a-e occurs (e.g., new services, legal changes, changes in delivery/payment).

  2. In the event of one of the above reasons, Natura Atelier shall send information about the planned amendment, along with the content of the new Regulations, to the Buyers' email addresses provided in the Store, at least 14 days before the planned effective date.

  3. A Buyer who does not accept the planned changes may terminate the Account agreement as specified in § 19 section 1 of the Regulations. Failure to terminate the Account agreement before the new version of the Regulations takes effect means it becomes binding on the Buyer.

 

VII. Final Provisions

§21 Governing Law

 

  1. Contracts concluded by Buyers with Natura Atelier based on the Regulations are governed by Polish law.

  2. This choice of law does not deprive the Consumer of the protection granted to them under the laws of the country where the Consumer has their habitual residence, which cannot be excluded by agreement.
